Terms of Service

Account eligibility and security

You must be legally able to enter a contract and provide accurate account information. You are responsible for activity under your account, protecting credentials, and promptly notifying us of suspected unauthorized access.

Subscription and payment

Paid memberships renew automatically at the price and interval shown at checkout until cancelled. Prices are shown in Canadian dollars unless stated otherwise and applicable taxes may be added. You can cancel through the Stripe billing portal; access continues through the end of the paid period. Except where required by law, payments for elapsed billing periods are non-refundable.

Your content

You retain ownership of content you upload. You grant Zary Studio OS a limited licence to host, process, display, transmit, and back up that content solely to operate, secure, and improve the service. You represent that you have the rights and permissions needed for uploaded photographs, client information, music, documents, and other materials.

Client transactions

Studios are the seller and service provider for products, sessions, invoices, galleries, and other client transactions they create. Studios are responsible for fulfilment, refunds, taxes, consumer obligations, product descriptions, permissions, and communications with their clients. Stripe or another processor may charge separate processing fees.

Acceptable use

You may not use the service to violate law or third-party rights, distribute malware or spam, bypass access controls, interfere with platform operation, scrape protected data, resell unauthorized access, or upload exploitative, abusive, or unlawful content.

Service changes and availability

We may improve, add, remove, or modify features. We aim for reliable service but do not promise uninterrupted availability. We may suspend access to protect users, investigate misuse, perform maintenance, comply with law, or address unpaid amounts.

Warranty and liability

To the extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties and are not liable for indirect, incidental, special, consequential, or lost-profit damages. Our aggregate liability for claims relating to the service will not exceed the amounts you paid to Zary Studio OS in the twelve months before the event giving rise to the claim.

Termination

You may stop using the service and cancel your subscription at any time. We may terminate or suspend accounts for material breach, unlawful use, security risk, or non-payment. Provisions that by their nature should survive termination will remain in effect.

Governing law

These terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law rules. Courts located in Ontario will have exclusive jurisdiction, except where consumer law requires otherwise.
